Abstract

The rapid growth of social commerce has transformed Instagram from a mere social media platform into a massive business platform, in part through the phenomenon of “Jasa Titip” (Jastip)—a service for purchasing goods from abroad. Although it provides consumers with greater accessibility, this practice raises critical ethical concerns and issues in Islamic commercial law (fiqh al-muamalah), such as a lack of price transparency, information asymmetry, and customs duty manipulation (under-invoicing). This study aims to identify critical ethical issues in the practice of overseas Jastip on Instagram and propose a reconstruction of an integrative Islamic business ethics model. Using a descriptive-analytical qualitative method with a netnographic approach and in-depth interviews, this study dissects the field reality using the analytical framework of the five pillars of Islamic business ethics (Tawhid, Justice, Free Will, Responsibility, and Virtue). The results indicate that the current shopping agency model tends to be trapped in practices involving gharar (uncertainty) and violations of formal state regulations, which contradict the principle of public interest. As a solution, this study reconstructs the operational model of jastip through an explicit transformation based on the Wakalah bil Ujrah contract, integrated with the optimization of Instagram’s transparency features. This reconstruction is expected to minimize moral hazard while providing practical, Sharia-compliant guidance for digital business operators.
